By accessing or using PulseMetrics Cloud ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service.
2. Description of Service
PulseMetrics Cloud provides analytics, reporting, and campaign management tools for social media professionals. The Service includes data visualization, automated reporting, team collaboration features, and API access subject to your subscription plan.
3. Account Registration
You must register for an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Subscription and Payments
The Service is offered on a subscription basis. Fees are charged in advance on a monthly or annual basis depending on your selected plan. All fees are non-refundable except as expressly provided in our Refund Policy.
5. Acceptable Use
You agree not to use the Service to: (a) violate any applicable laws or regulations; (b) infringe intellectual property rights; (c) transmit harmful code or malware; (d) attempt to gain unauthorized access to the Service or its related systems; (e) interfere with other users' access to the Service.
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, and sharing of your data as described in the Privacy Policy.
7. Intellectual Property
All content, trademarks, and intellectual property related to the Service are owned by PulseMetrics Cloud or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
8. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. You may cancel your subscription at any time through your account settings. Upon termination, your right to use the Service ceases immediately.
9. Limitation of Liability
To the maximum extent permitted by law, PulseMetrics Cloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
